On December 10, 2012, Judge Robert L. Miller, Jr., Chief Judge for the United States District Court for the Northern District of Indiana, appointed Mike McGlamry of Pope McGlamry P.C. as one of the members of the Plaintiff Steering Committee in the Biomet M2a Magnum Hip Implant Products Liability Litigation (MDL 2391).
Litigation involving the Biomet M2a metal-on-metal hip replacement system was consolidated by the United States Judicial Panel on Multidistrict Litigation (JPML) by order dated October 2, 2012. The consolidated proceeding has been assigned to the Judge Miller in the Northern District of Indiana. The JPML found that pretrial consolidation was beneficial because, “Centralization will eliminate duplicative discovery, prevent inconsistent pretrial rulings on discovery and other issues, and conserve the resources of the parties, their counsel and the judiciary.”
The Biomet M2A-Magnum Hip is a metal-on-metal hip replacement system marketed to young, active patients. However, these lawsuits suggest that the hip implant is prone to fail within only a few years of surgery. In addition, the American Academy of Orthopaedic Surgeons warns consumers and medical providers that any metal-on-metal implant might lead to metallosis; Friction caused by two metal surfaces rubbing against each other may cause small metal fragments being shed into the surrounding tissue and blood stream.
